By accessing or using xtec.dev (the “Service”) you agree to these Terms of Use. If you do not accept them, do not use the Service. The Service is operated by David de Mingo, in a personal capacity — see the Legal notice for operator details and the Privacy policy for how data is handled.

Agreement to Terms

These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and concerning your access to and use of the Website and the Services. You agree that by accessing the Services, you have read, understood, and agree to be bound by all of these Terms of Use. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF USE, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.

Supplemental terms and conditions or documents that may be posted on the Website from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Use from time to time. We will alert you about any changes by updating the “Last updated” date of these Terms of Use, and you waive any right to receive specific notice of each such change. It is your responsibility to periodically review these Terms of Use to stay informed as each time you access the Services, you will be subject to, and will be deemed to have been made aware of and to have accepted, the then applicable Terms of Use.

Nature of the Service

xtec.dev is a personal teaching tool for organising a teacher’s own work: tools that display and cross-reference data the teacher is already authorised to see in their school’s Moodle and in Esfera.

It is not an official service of any educational centre or of the Department of Education (Generalitat de Catalunya). It does not replace, represent, or speak for those systems. Each user uses it under their own professional responsibility and must ensure that this use is compatible with their centre’s guidelines.

Accounts and access

You can sign in with your school Moodle or with Esfera/GICAR. You are responsible for the credentials you use and for all activity under your account. Authentication is delegated to your provider; we never store your password (see the Privacy policy). Do not share your account, and tell us if you believe it has been accessed without your authorisation.

Acceptable use

You agree to use the Service lawfully and only with data you are authorised to access. You will not:

  • access, or attempt to access, data of students or staff outside your own teaching responsibility;
  • use the Service to breach your centre’s, Moodle’s, or Esfera’s access conditions;
  • attempt to disrupt, overload, reverse-engineer, or gain unauthorised access to the Service or its infrastructure;
  • export, publish, or share personal data obtained through the Service except as required for your legitimate teaching work.

Grading and Esfera

The grading tools only read from Esfera; they never write grades or any other data into Esfera or any other official system. The Service calculates and displays learning-outcome marks, but it is the teacher who enters the official grades into Esfera from the official screen, as the authorised actor. You are solely responsible for the correctness of any grade you record in an official system.

Intellectual property

The Service’s software and design are the property of the operator and are protected by intellectual-property law. These Terms grant you a personal, non-transferable right to use the Service for your own teaching work; they transfer no ownership. Data belonging to your centre or to the Generalitat remains theirs.

Availability and warranties

The Service is provided “as is” and “as available”, with no warranty of uninterrupted or error-free operation, fitness for a particular purpose, or accuracy of data retrieved live from third-party systems (Moodle, Esfera). We may modify, suspend, or discontinue the Service at any time.

Limitation of liability

To the maximum extent permitted by law, the operator is not liable for indirect or consequential damages, loss of data, or any harm arising from your use of the Service, from decisions taken on the basis of data it displays, or from grades you enter into official systems. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

Data protection

The processing of personal data is governed by the Privacy policy, which forms part of these Terms.

Governing law

These Terms are governed by Spanish law. Any dispute will be subject to the courts of the operator’s domicile in Catalonia, Spain, except where consumer-protection law grants you a different competent court.
